Welcome to Coaching Season LLC! These Terms of Service (“Terms”) govern your access to and use of our website, services, and products (collectively, the “Services”). By using our Services, you agree to comply with these Terms. Please read them carefully. If you do not agree to these Terms, you must not use our Services.

1. Services Overview

Coaching Season LLC provides leadership coaching, personal development programs, and consulting services tailored to meet individual and organizational needs. All services are delivered with professionalism and integrity and align with Coaching Season LLC’s mission, vision, and values.

Your individual or organizational agreement will outline the scope, duration, and structure of Services.

2. Eligibility

By accessing or using our Services, you represent and warrant that:

  • You are at least 18 or of legal age in your jurisdiction.
  • You can legally enter into a binding contract with Coaching Season LLC.
  • You are accessing the Services for lawful purposes and in compliance with these Terms.

3. Client Responsibilities

You agree to:

  • Participate actively in coaching sessions and complete any assignments or actions agreed upon.
  • Provide accurate and complete information to facilitate the coaching process.
  • Respect confidentiality agreements and boundaries established during the coaching relationship.
  • Maintain respectful and professional communication with your coach and Coaching Season LLC staff.
  • Understand and accept that coaching results depend on your engagement and commitment.

4. Confidentiality

Coaching Season LLC is committed to maintaining the confidentiality of all client information. Personal or sensitive information shared during the coaching process will not be disclosed without your explicit written consent except in the following circumstances:

  • As required by law.
  • If there is a reasonable belief that disclosure is necessary to prevent harm to yourself or others.

All discussions, session content, and coaching records are treated as confidential and securely stored.

5. Data Privacy and Security

We prioritize the security and privacy of your data. By using our Services, you agree to our Privacy Policy, which outlines how we collect, use, store, and safeguard your personal information. For more details, please refer to our Privacy Policy.

6. Payment, Refunds, and Cancellation Policy

  • Payment Terms: Payment for Services must be made in advance or as specified in your coaching agreement. All payments are processed securely.
  • Refund Policy: Refunds for unused coaching sessions will be considered case-by-case. Refunds are not guaranteed and are subject to administrative and processing fees.
  • Rescheduling Policy: Sessions with at least 24 hours’ notice may be rescheduled. Sessions canceled with less notice may be forfeited unless due to an emergency.
  • Package Expiration: Coaching packages and session credits must be used within the agreed-upon timeframe. Unused sessions will expire unless an extension is agreed upon in writing.

7. Force Majeure

Coaching Season LLC is not liable for delays or failures to perform Services due to events outside our reasonable control, including but not limited to natural disasters, pandemics, strikes, acts of war, government restrictions, or technical failures.

8. Intellectual Property

Copyright and intellectual property laws protect all content, materials, tools, and resources Coaching Season LLC provides. You may not modify, reproduce, or distribute any materials without prior written consent.

Intellectual property rights are jointly owned unless otherwise agreed in writing for any co-created materials during coaching sessions (e.g., frameworks, action plans). Coaching Season LLC retains the right to anonymize and use such materials for training, research, or promotional purposes.

9. Session Recording and Use

Coaching sessions may be recorded only with your explicit consent. Recorded sessions are used for quality assurance, training, or documentation purposes and are securely stored. You may request access to or delete recordings by contacting us in writing.

10. Client Conduct

Clients are expected to:

  • Treat coaches and Coaching Season LLC  volunteers with respect.
  • Honor scheduled appointments and engage professionally.
  • Adhere to the agreed-upon terms of the coaching relationship.

Harassment, abusive behavior, or repeated failure to adhere to agreed conduct may result in immediate termination of Services without a refund.

11. Termination of Services

  • By Coaching Season LLC: We may terminate Services immediately if you breach these Terms, fail to make payments or engage in conduct harmful to the coaching process.
  • By Client: Clients may terminate Services by providing at least 7 days' written notice. Refunds for unused sessions will be determined according to our Refund Policy.

12. Accessibility and Accommodation

Coaching Season LLC is committed to inclusivity and accessibility. If you have specific needs or require accommodations, please notify us in advance so we can make appropriate arrangements to support your engagement in the coaching process.

13. Dispute Resolution and Arbitration

In the event of a dispute, both parties agree to resolve the matter through good-faith mediation. If mediation fails, disputes will be resolved through binding arbitration. The arbitration decision shall be final and binding.

Each party is responsible for its own legal fees and costs associated with the dispute.

14. Disclaimer of Guarantees

Coaching Season LLC makes no guarantees regarding specific outcomes or results from coaching Services. Coaching is a collaborative process; success depends on active participation and effort. All Services are provided “as is” without express or implied warranties.

15. Limitation of Liability

To the fullest extent permitted by law, Coaching Season LLC is not liable for:

  • Indirect, incidental, or consequential damages arising from your use of the Services.
  • Losses resulting from decisions you make based on coaching discussions.

Total liability is limited to the amount paid for the applicable Service.

16. Service-Specific Terms

These Terms apply to all Services provided by Coaching Season LLC. Specific terms may apply to group coaching, corporate engagements, or custom programs and will be outlined in your agreement or engagement letter.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of New Jersey. Any disputes arising under these Terms shall be resolved exclusively in the courts of New Jersey.

18. Amendments

Coaching Season LLC reserves the right to update these Terms at any time. Changes will be effective upon posting to our website. Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
